Privacy and personal data protection policy

1. Data controller

ZYNGO SAS, tax ID (NIT) 902096826-0, registered at CL 2B 17 68, Rionegro, Antioquia, Colombia, is the controller of the personal data collected through this website and its associated contact channels.

Contact channels: adminzyngo@gmail.com and the chat on zyngosas.com. Any request regarding your personal data may be sent to either of them.

2. Data we collect

We only collect the data you choose to give us. In ZYNGO Studio and in the business assessment the contact fields are optional: you can generate your proposal without filling them in.

• Identification and contact: name, company, email address and WhatsApp number, when you type them into a form.
• Project information: the description of your idea or your operation, the sector and any clarifications you give us.
• Client portal account, if you are a client: name, email, company and phone, plus the documents, deliverables and invoices for your project.
• Technical usage data: type of action performed and page visited, with no personal identifier.
• IP address, transiently and only in the server memory, to limit the number of requests and stop abuse. It is not stored in a database nor linked to your name.

3. What we do NOT do

Worth being explicit, because it is not the norm:

• We do not sell, rent or transfer your personal data to third parties.
• We do not load advertising cookies without your permission: the Meta pixel is only activated if you accept it in the notice, and if you decline, it is never loaded.
• Our own analytics stores no IP addresses and no personal identifiers: it counts actions, not visitors.
• We do not show third-party ads inside the site.

4. Purposes of processing

We use your data solely to:

• Generate the preliminary proposal for your project and let you review and modify it.
• Deliver the technology assessment of your company when you request it.
• Contact you to expand on the information and prepare a commercial proposal.
• Provide, manage and invoice the contracted services, including the client portal.
• Comply with legal, accounting and tax obligations.
• Measure in aggregate how the site is used, in order to improve it.

5. Automated generation of proposals

The proposal delivered by ZYNGO Studio, including the scope and the time estimate, is generated automatically from what you write. It is a preliminary, indicative reading: it is not a commercial offer and produces no legal or contractual effects.

To generate it, the text of your idea, the sector and the company name are processed through an artificial intelligence provider (Groq, Inc., United States). Your name, your email address and your WhatsApp number are NOT sent to that provider.

The final scope and value of a development are always reviewed and agreed with you by a person from the ZYNGO SAS team.

6. Processors and international transfers

To operate the site we rely on third parties acting as data processors, bound by confidentiality and security obligations. Some are located outside Colombia, which involves an international transfer of data that you accept by using the site:

• Hosting of the site and the database, on a server under our control.
• Groq, Inc. (United States): processing of the text of your idea to generate the proposal, as explained in the previous section.
• Meta Platforms, Inc.: if you choose to message us on WhatsApp, as explained in the next section; and, only if you accept advertising measurement, the data collected by its pixel as described in the cookie policy.

7. Contact via WhatsApp

WhatsApp is our main commercial contact channel. The buttons on this site open a conversation with our number and, in some cases, carry a pre-written message summarising the project you have just generated. You can edit or delete it before sending: nothing is sent unless you press send.

The conversation takes place inside WhatsApp, a service of Meta Platforms, Inc. The content of the messages, your number and your public profile are also governed by Meta policies, over which ZYNGO SAS has no control. We recommend reading them at https://www.whatsapp.com/legal/privacy-policy

On our side, we keep the conversation history and the contact details you share with us in order to handle your request and follow up commercially, under the same purposes and rights described in this policy.

We do not send bulk or unsolicited promotional messages. If you write to us and later prefer not to hear from us, reply "stop contacting me" on the same channel and we close the follow-up.

8. Cookies and storage in your browser

This site works without advertising cookies. Measurement cookies are only loaded if you accept them in the notice shown when you arrive, and declining them limits no feature. We use:

• Technical session cookies: only if you sign in to the internal panel or the client portal. They are required to keep the session open and expire when it is closed.
• Meta advertising measurement cookies: only with your express acceptance, to learn which ads bring real clients. They are detailed in the cookie policy.
• Local storage (localStorage): keeps in YOUR browser the history of the proposals you generate in ZYNGO Studio, so you can reopen them. That information never reaches our servers and you can remove it by clearing the site data.

9. Data retention

We keep data for as long as the purpose that originated it requires:

• Contacts and proposals from prospective clients: while commercial interest exists and for up to two years after the last contact, unless you ask for deletion sooner.
• Data of clients with a contracted project: throughout the contractual relationship and for the additional period required by Colombian legal, accounting and tax obligations.
• Aggregate technical usage records: kept indefinitely, as they contain no personal data.

10. Rights of the data subject

Under Colombian Law 1581 of 2012 and Decree 1074 of 2015, as a data subject you have the right to: access, update and rectify your data; request proof of the authorisation given; be informed about the use we make of your data; revoke the authorisation and request deletion where no legal or contractual duty prevents it; and file complaints with the Superintendency of Industry and Commerce.

To exercise them, write to adminzyngo@gmail.com or use the chat on zyngosas.com stating your request and a detail that identifies you. We answer enquiries within a maximum of ten (10) business days and complaints within a maximum of fifteen (15) business days, as required by law. If we need more time we will tell you before the deadline, with the reasons.

11. Information security

We apply reasonable technical, human and administrative measures: encryption in transit via HTTPS, passwords stored with key-derivation functions resistant to brute force, signed sessions, role-based access control and per-origin request limits.

Client portal documents and invoices are not published at guessable addresses: they are served through a check that verifies who is requesting them.

No system is infallible, but we treat your information to the same standard we apply to the systems we build for our clients.

12. Minors

This site is aimed at companies and adults. We do not knowingly collect data from minors. If we detect that we have received data from a minor without the authorisation of their legal guardian, we will delete it.

13. Changes to this policy

We may update this policy to reflect legal changes or changes to our services. The version in force is always the one published on this page, with its update date. If a change is substantial and affects the use of data already collected, we will inform you through the contact channels you have given us.
